The reconstruction of bacterial evolutionary relationships has proven to be a daunting task because variable mutation rates and horizontal gene transfer (HGT) among species can cause grave incongruities between phylogenetic trees based on single genes. Recently, a highly robust phylogenetic tree was constructed for 13 γ‐proteobacteria using the combined alignments of 205 conserved orthologous proteins.1 Only two proteins had incongruent tree topologies, which were attributed to HGT between Pseudomonas species and Vibrio cholerae or enterics. While the evolutionary relationships among these (...) species appears to be resolved, further analysis suggests that HGT events with other bacterial partners likely occurred; this alters the implicit assumption of γ‐proteobacteria monophyly. Thus, any thorough reconstruction of bacterial evolution must not only choose a suitable set of molecular markers but also strive to reduce potential bias in the selection of species. Within the academic community there has been debate around whether business ethics should be taught as a stand-alone course or rather integrated across the business curriculum. A different tack is taken here as we head in the direction of integrating business ethics beyond the traditional bounds of the business curriculum and into theatre arts. The collaboration outlined herein was established when an inter-College alliance was formed to create the devised play Cheat, a mainstage theatre production for Western Washington University (WWU), (...) in which theatre became the ground and moral theory from business ethics became the figure. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. The relationship between being and consciousness has been characterised as one of alienation , reification , instrumentalization , and 'one dimensionalization' . More recently Jurgen Habermas has described the 'colonization of the lifeworld'. Each of these theorists argues that social and political philosophy has two primary tasks. First, a political philosophy should construct a model of how we might best structure our social and political situation so as to maximize freedom and self-determination. Second, a political philosophy should provide an analysis (...) of presently existing conditions. The gap between the model and the actually existing reality provides the space for social and political criticism, as well as social and political struggle. In his account of 'the colonization of the lifeworld', Habermas attempts to explain the relation between being and consciousness in terms of his theory of communicative action and to locate possible points of social and political crisis in advanced capitalist society. ;In this dissertation I trace theories of the relationship between being and consciousness from Marx through Lukacs and the Frankfurt School to Habermas' recent work The Theory of Communicative Action. I argue that in terms of his stated goal of providing a critical social theory with practical intent Habermas has been only partially successful. I present an account of Habermas' theory and claim it is potentially more politically efficacious than post-structuralist theories, though only if his theory is attentive to the concerns of those same post-structuralist theories. After arguing that at a certain level of abstraction Habermas is right in his account of our present situation, I conclude that he falls short of his goal in so far as his theory fails to take adequate account of many actually existing struggles for political self-determination, and many hypotheses for alternative social organization which do not agree with his assumptions about validity and consensus. Among multiple legal challenges to the Patient Protection and Affordable Care Act (PPACA) is the premise that PPACA's “individual mandate” (requiring all individuals to obtain health insurance by 2014 or face civil penalties) is inviolate of Congress' interstate commerce powers because Congress lacks the power to regulate commercial “inactivity.” Several courts initially considering this argument have rejected it, but federal district courts in Virginia and Florida have concurred, leading to numerous appeals and prospective review of the United States Supreme Court. (...) Despite creative arguments, the dispositive constitutional question is not whether Congress' interstate commerce power extends to commercial inactivity. Rather, it is whether Congress may regulate individual decisions with significant economic ramifications in the interests of protecting and promoting the public's health. This article offers a counter-interpretation of the scope of Congress' interstate commerce power to regulate in furtherance of the public's health. (shrink)

We approach the physics of \emph{minimal coupling} in general relativity, demonstrating that in certain circumstances this leads to violations of the \emph{strong equivalence principle}, which states that, in general relativity, the dynamical laws of special relativity can be recovered at a point. We then assess the consequences of this result for the \emph{dynamical perspective on relativity}, finding that potential difficulties presented by such apparent violations of the strong equivalence principle can be overcome. Next, we draw upon our discussion of the (...) dynamical perspective in order to make explicit two `miracles' in the foundations of relativity theory. We close by arguing that the above results afford us insights into the nature of special relativity, and its relation to general relativity. (shrink)

This study examines the presence and roles of female directors of U.S. Fortune 500 firms, focusing on committee assignments and director background. Prior work from almost two decades ago concludes that there is a systematic bias against females in assignment to top board committees. Examining a recent data set with a logistic regression model that controls for director and firm characteristics, director resource-dependence roles and interaction between director gender and director characteristics, we find that female directors are less likely than (...) male directors to sit on executive committees and more likely than male directors to sit on public affairs committees. There is little if any evidence of systematic gender bias in director assignment to other board committees. We find some evidence that boards evaluate resource dependence differently for women than men. (shrink)

This report describes research focusing on virtues and character in teaching, by which we mean the kind of personal qualities professional teachers need to facilitate learning and overall flourishing in young people that goes beyond preparing them for a life of tests. The ‘good’ teacher is someone who, alongside excellent subject knowledge and technical expertise, cares about students, upholds principles of honesty and integrity both towards knowledge and student–teacher relationships, and who does good work . In the Framework for Character (...) Education , we considered the character of teachers to be a crucial ingredient in the development of flourishing children. This new report describes research that examined how teachers thought about, and drew upon, character strengths and virtues in their daily professional lives. (shrink)

Despite the lack of invariance problem (the many‐to‐many mapping between acoustics and percepts), human listeners experience phonetic constancy and typically perceive what a speaker intends. Most models of human speech recognition (HSR) have side‐stepped this problem, working with abstract, idealized inputs and deferring the challenge of working with real speech. In contrast, carefully engineered deep learning networks allow robust, real‐world automatic speech recognition (ASR). However, the complexities of deep learning architectures and training regimens make it difficult to use them to (...) provide direct insights into mechanisms that may support HSR. In this brief article, we report preliminary results from a two‐layer network that borrows one element from ASR, long short‐term memory nodes, which provide dynamic memory for a range of temporal spans. This allows the model to learn to map real speech from multiple talkers to semantic targets with high accuracy, with human‐like timecourse of lexical access and phonological competition. Internal representations emerge that resemble phonetically organized responses in human superior temporal gyrus, suggesting that the model develops a distributed phonological code despite no explicit training on phonetic or phonemic targets. The ability to work with real speech is a major advance for cognitive models of HSR. (shrink)

Bolanski explains why he regards May 1968 as a major disruption of the capitalist (...) social order and how the conservative response to this contestation subsequently prevailed in France. Agency and Imagination in the Films of David Lynch: Philosophical Perspectives offers a sustained philosophical interpretation of the filmmaker’s work in light of classic and contemporary discussions of human agency and the complex relations between our capacity to act and our ability to imagine.

We conducted a narrative review of existing literature to identify the knowledge, skills, and abilities necessary for officers who police in democratic societies to successfully manage potentially volatile police–public interactions. This review revealed 10 such KSAs that are frequently discussed in the literature. These KSAs include: knowledge of policies and laws; an understanding of mental health-related issues; an ability to interact effectively with, and show respect for, individuals from diverse community groups; awareness and management of stress effects; communication skills; decision-making (...) and problem-solving skills; perceptual skills; motor skills related to use-of-force; emotion and behavior regulation; and an ability to treat people in a procedurally just manner. Following our review, we conducted semi-structured interviews with researchers who specialize in police training and adult education, interactions with individuals in crisis, and racialized policing, as well as two police trainers with expertise in de-escalation and use-of-force training. These interviews confirmed the importance of the 10 KSAs and highlighted two additional KSAs that are likely to be critical: understanding the role of policing in a free and democratic society and tactical knowledge and skills. To ensure that police–public interactions are managed effectively, police trainers may want to focus on the development and evaluation of these KSAs—something that is not always done currently. We review the dynamical approach to spacetime theories---in particular, its origins in the development of special relativity, its opposition to the contemporary `geometrical' approach, and the manner in which it plays out in general relativity. In addition, we demonstrate that the approach is compatible with the `angle bracket school'.

Social Theory and the Political Imaginary: Practice, Critique and History is an innovative work of synthesis, critique, and analysis. It presages a social theory perspective that recognises the constitutive significance of the political imaginary in modernity. Social theory's current dilemmas are explored through a series of interlinked asssessments of some of its recent substantial strands, specifically, Luc Boltanski's pragmatism and the wider 'practical turn', the perspectives of multiple modernities and global modernity, the outlook of social and political imaginaries, and critical (...) social theory. The political imaginary's reconfigurations are evident in the tensions of global modernity and original social theory interpretations are advanced of landmark instances of twenty-first century social contestation: the Hong Kong protests conditioned by threats to civil freedoms and a lack of self-determination, the radical democratic practices of anti-austerity movements contesting capitalist globalisation's injustices, and the inverted cosmopolitanism of the 2005 French Riots challenging the oppression and inequalities experienced by immigrant communities and marginalised youth. These incisive applications of social theory and complementary conceptual innovations illuminate the vicissitudes of social struggles, political forms, and theoretical perspectives. At times of crisis, existing institutional arrangements of societies are thrown into question. Crises that occur in multiple societies simultaneously present rare opportunities for comparative empirical analysis. Social theory can reveal the framing conditions of the responses to crises and the sources of variations between them. This paper compares the immediate responses of the Australian, UK and US governments to the global COVID-19 pandemic, particularly with regard to financing lockdowns, and points out significant differences between the three approaches. Drawing on (...) Polanyi’s method of institutional analysis, we compare the responses of these same national groups to an earlier crisis, the Japanese prisoner of war camps during the Second World War, to show similar patterns of integration recurring eight decades apart. This analysis shows that aspects of moral economies that are not usually apparent can become pronounced during crises, and points to the importance of enduring social imaginaries. (shrink)
